  • Does my project need a SWPPP?
    The construction general permit requires a SWPPP for dischargers disturbing 1 or more acres of soil.
  • Are Inspections required?
    Weekly inspections of BMPs are required under the construction general permit along with rain event related inspections that can vary state to state.
  • Can anyone perform SWPPP inspections?
    One must be a competent person, or a QSP to perform inspections.
  • Can inspections be conducted by a third party?
    Yes, inspections can be conducted in-house or by a third party.
  • Who is responsible for SWPPP compliance?
    A good contractor will follow SWPPP requirements, but ultimately the property owner is the legally responsible person or LRP.
  • What happens if I don’t comply with SWPPP?
    There are significant penalties for not complying with the SWPPP or State regulations. Any person who violates these regulations may be subject to fines of $37,500 per day of violation or imprisonment.
